Intellectual Property 

  1. Irongate Content: All content on irongatedatacenters.com, including text, graphics, logos, images, software, and the overall design ("Irongate Content"), is the exclusive property of Irongate or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from Irongate Content without our express written permission.
  2. User Content/Data: The Customer shall retain all rights, title, and interest in and to all Customer Content. This data is specifically acknowledged as the Customer’s Confidential Information. The Customer is solely responsible for the legality, accuracy, integrity, and quality of the data they provide.
  3. Service Output: Irongate typically retains ownership of all proprietary platform IP, while users are given a limited license to use the output for internal business purposes.

User Conduct and Prohibited Uses

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited activities include, but are not limited to:

  • Engaging in any illegal activities.
  • Attempting unauthorized access to our systems or networks.
  • Distributing malware, viruses, or any other harmful code.
  • Reverse engineering, decompiling, or disassembling any part of the Service. ● Spamming or sending unsolicited communications.

  1. Service Provided "As Is": The Irongate Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  2. Limitation of Liability: To the fullest extent permitted by applicable law, Irongate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your access to or use of or inability to access or use the Service.
    • Any conduct or content of any third party on the Service.
    • Any content obtained from the Service.
    • Unauthorized access, use, or alteration of your transmissions or content.
  3. General Liability Cap: Irongate’s total liability for any claim arising from or related to the services shall not exceed the total fees paid by the customer during the six (6) to twelve (12) months preceding the event giving rise to the claim.
